Lien Search/Title Search

For purchases and refinances, we do extensive property searches to ensure that all titles are clean prior to closing on the specific property. This includes Lien and Title Searches. We make sure the entire process goes smoothly without any surprises and we communicate them directly to the client.

Title History

Prior to a transaction on any property, your attorney will search public records on the property’s ownership. The search will check for claims, code violations, liens, and ownership associated with the property being sold or purchased. Once the search is finished, any issues need to be resolved before a closing will be authorized.

Some problems are easily cleared up while others may take so long that they jeopardize your loan commitment. Our commitment to you as a Baez Law client is to clean up any of these hold ups as quickly as possible. We want the closing to be as painless and quick for you and your lenders as possible.

Purchase and Sale/Closing

A purchase and sale agreement is a legally binding contract that we review as a courtesy to our clients. This agreement ensures the protection of our clients’ rights and interests. However, we represent the lender in all closings.

We go through the agreement with you and make sure that you understand what you are signing and negotiate with the opposing attorney in the transaction.

Prior to closing, we go over all final numbers and answer any questions that may arise before signing. If you are purchasing your property with financing, we will conduct the closing for both our clients and the bank. Once all documents are signed your property is officially yours!

Rental Agreements

Before providing or signing an agreement of residency, both landlords and tenants should know their rights and responsibilities. Consider what type of lease it is. Is the lease based on a certain amount of time, typically a year, or month-to-month? In both cases there are obligations necessary to both parties.

Every rental agreement must have certain terms. The lease must include the name, address, and phone number of the owner, the person responsible for maintenance, and the person to whom the tenant can give copies of formal notices, complaints, or court papers.
If the landlord receives a security deposit, the lease or rental agreement must show the amount paid, and must explain the tenant’s rights to that security deposit money.

The landlord must make sure that the tenant is given a legible copy of the lease or rental agreement. The lease must not include illegal terms such as:

  • The tenant must pay for the cost of repairing ordinary wear and tear to the apartment.
  • The tenant must pay for repairs to parts of the building beyond the tenant’s apartment.
  • The tenant may not sue the landlord or report violations of the Sanitary Code.
  • The tenant may not join a tenants’ union.
  • The tenant must pay a late fee if a rent payment is even one day late. (A lease or rental agreement may permit the landlord to charge a late fee if a rent payment is 30 or more days late.)

Having a thorough, legal lease agreement ensures landlords are protecting their best interests.
