Attorneys review contracts with clients prior to signing. In Massachusetts, it’s the law; an attorney MUST conduct the closing. They help you understand your legal rights and help resolve legal issues as they arise during the transaction. In addition to advising you through a closing, they also make sure the property title is clean prior to closing thereby facilitating  a smooth closing transaction.

Attorney fees are already included in your closing costs. Many attorneys charge an additional fee to review Purchase & Sale agreement however, Baez Law group does not charge a fee to review so long as we are conducting the closing.

A buyer’s attorney represents a buyer solely for their real estate transaction. A lender’s attorney represents the lender and conducts the closing. However, most buyer attorneys are allowed to close transactions as long as there are no conflicts of interest between the buyer and lender.

We highly recommend that anyone looking to sell home obtain their own legal representation to protect their rights and interests every step of the way. There is a misconception that sellers do not need to obtain legal representation as the closing attorney can prepare their seller docs. However, the closing attorney’s duty is to the buyer and lender, not the seller. Hence the seller’s rights may not be protected.
